HeadShot AI: Terms of Service

1. Introduction

Welcome to HeadShot AI. These Terms of Service ("Terms") govern your use of our mobile application (the "App") and the services provided through it. By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

HeadShot AI is a mobile application that uses artificial intelligence to generate professional-quality headshots from your photos.

2. Acceptance of Terms

By downloading, installing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are using the App on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

3. Description of Service

HeadShot AI provides an AI-powered service that generates professional headshots based on images you upload. The service includes:

• Processing your uploaded images to create AI-generated headshots
• Storing your images temporarily to fulfill your orders
• Providing you with access to download your generated images
• Optional premium features that may be available for purchase

4. User Accounts and Eligibility

You must be at least 13 years of age to use the App. If you are under 18, you must have permission from a parent or legal guardian. By using the App, you represent and warrant that you meet these eligibility requirements.

Depending on the features you use, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

5. User Content and Rights

a. Your Content

When you upload images to the App ("User Content"), you retain ownership of your User Content. However, you grant us a limited license to use, reproduce, and process your User Content solely for the purpose of providing the services to you.

b. Restrictions on User Content

You agree not to upload images that:

• Contain illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable content
• Infringe on the intellectual property rights of others
• Contain images of individuals other than yourself without their consent
• Contain images of minors without parental consent
• Violate any applicable laws or regulations

c. AI-Generated Images

The AI-generated headshots created through our service ("Generated Images") are provided to you for your personal or commercial use, subject to the following conditions:

• You may use the Generated Images for personal or professional purposes, including on social media, professional profiles, and business materials
• You may not use the Generated Images in a way that violates any laws or regulations
• You may not redistribute or resell the Generated Images as stock photography or as part of an image collection

6. Payments and Subscriptions

HeadShot AI may offer both free and paid services. For paid services:

• All prices are in the currency specified at the time of purchase
• Payment will be charged to your chosen payment method at confirmation of purchase
• If you purchase a subscription, it will automatically renew unless you turn off auto-renewal at least 24 hours before the end of the current period
• You can manage and cancel subscriptions through your app store account settings
• No refunds will be provided for partial subscription periods

7. Intellectual Property

The App, including its content, features, and functionality, is owned by HeadShot AI and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our explicit permission.

8. Limitation of Liability

To the maximum extent permitted by law, HeadShot AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the App.

Our total liability for any claims under these Terms shall not exceed the amount you paid to us for the App in the past 12 months (or $10 if you have not made any payments).

9. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the App will always be safe, secure, or error-free, or that it will function without disruptions, delays, or imperfections.

We do not guarantee the quality, accuracy, or suitability of the Generated Images for any particular purpose.

10. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the App will immediately cease, but all provisions of these Terms that by their nature should survive termination shall survive.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of any changes by posting the new Terms within the App. Your continued use of the App after such changes constitutes your acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which HeadShot AI operates, without regard to its conflict of law provisions.
